A. When Permitted: Nudity is prohibited in a nude model studio. However, an exception may be granted in the reasonable discretion of the director upon a finding that the operation is in fact a bona fide art instruction business.
B. Employment Of Minor Prohibited: A nude model studio shall not employ any person under the age of eighteen (18) years.
C. Minors Appearing Nude Prohibited: It shall be unlawful for a person under the age of eighteen (18) years to appear in a state of nudity in or on the premises of a nude model studio.
D. Nudity Prohibited Within View: It shall be unlawful to appear in a state of nudity, or knowingly allow another to appear in a state of nudity or seminudity, in an area of a nude model studio premises which can be viewed from a public right of way.
E. Bed, Sofa Or Mattress Prohibited; Exception: A nude model studio shall not place or permit a bed, sofa or mattress in any room on the premises, except that a sofa may be placed in a reception room open to the public.
F. Defense To Prosecution: It is a defense to prosecution under this chapter that a person appearing in a state of nudity or seminudity did so in a modeling class operated by either a proprietary school licensed by the state, a college, junior college, or university supported entirely or partly by taxation, or by a private college or university that maintains and operates educational programs in which credits are transferable to a college, junior college or university supported entirely or partly by taxation.
