Arrest of a person charged with a misdemeanor under an ordinance of the village or section of this code may be made by taking the person charged into custody or by serving him or her with an arrest notice. Such arrest notice may be served by the arresting officer when he or she is satisfied that the defendant has a continuing bona fide residence in the village, that he or she will obey the order of arrest and all orders of the court, and that peace and order will be subserved by not taking such persons into custody. The defendant shall in such cases acknowledge in writing the service of notice and shall agree to obey its order and all orders of the court.
