§ 112.04 BULK MATERIALS TRANSPORT FUND.
   (A)   There is hereby created a fund known as the Bulk Materials Transport Fund, which shall be the depository of all the fee proceeds generated from this chapter.
   (B)   Such funds shall not be used for any general fund purpose of the village, but shall be restricted solely to expenditure in order to protect the public health, safety, and welfare of residents for expenses directly related to the transportation, shipping, and receiving of bulk materials, including, but not limited to, the following items:
      (1)   To provide sufficient funds in order to meet the specialized and local cost of the village resulting from the transportation and proper monitoring of the trucks utilizing the roadways to and from the bulk materials shipping facilities;
      (2)   The cost of road construction, maintenance, and repair for the weight of the trucks utilizing safe roads to and from the sites;
      (3)   The costs of necessary insurance premiums for liability insurance for the village for potential future claims against the village resulting from the transportation of bulk materials;
      (4)   The cost of engineering, legal, and other professional services necessary to monitor the transportation of bulk materials; and
      (5)   The cost incurred by the village to carry out the provisions of this chapter.
