For the purpose of this subchapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.
AUCTIONEER. Any person who engages in the business of selling or offering for sale, personal property of any kind, to the highest bidder at public auction, vendue, or outcry; excepting a fiduciary, officer, or other person acting under or by virtue of a judicial or statutory order, process, or authority; a vendor of chattels or merchandise which he or she desires to sell at public auction and which are not acquired by him or her for the purpose of sale at auction; and excepting the vendor of any product of his or her own raising, or manufacture by himself or herself; any bona fide organization conducting an auction, the proceeds from which are to be used for charitable or religious purposes.
