§ 154.99 PENALTY.
   (A)   Failure to comply. In case any person refuses to comply with an order issued pursuant to the above provisions, in addition to the penalties provided by this Code, the City of Wellston may institute civil proceedings to enforce compliance with the order.
   (B)   Penalties. Any person violating a provision of this chapter on a first offense shall be deemed guilty of a minor misdemeanor and fined not more than $100; a second offense within a two-year period shall be deemed a misdemeanor of the fourth degree, punishable by not more than 30 days in jail and a fine of not more than $250; a third offense within a two-year period shall be deemed a misdemeanor of the third degree, punishable by not more than 60 days in jail and a fine of not more than $500; and a fourth offense within a two-year period shall be deemed a misdemeanor of the second degree, punishable by not more than 90 days in jail and a fine of not more than $750. Each calendar day such violation continues shall constitute a separate and complete offense.
