§ 150.02 INSPECTION AND NOTICE TO OWNER.
   (A)   The Director of Public Safety and Service shall examine or cause to be examined every building or structure or portion thereof reported as, or believed to be, an unsafe building as defined in § 150.01.
   (B)   If the Director of Public Safety and Service concludes that the building is unsafe, then he or she shall give written notice to the following:
      (1)   The owners of record;
      (2)   Any vendee under a recorded land contract;
      (3)   Any holders of legal or equitable liens of record; and
      (4)   Any non-owner occupants of the building.
   (C)   The notice shall include information as follows:
      (1)   Indicating the city’s intention to proceed to abate the nuisance by repair or rehabilitation or demolition, within a time frame stated in the notice. The time frame shall be 30 days, except that if the Director of Public Safety and Service reasonably concludes that an emergency is present, a shorter period may be specified. The time frame shall commence upon service of the notice;
      (2)   Identifying the defects that cause the building to be unsafe;
      (3)   Informing the notice recipient that he or she may make a written agreement with the city, under which the recipient will abate the nuisance prior to the city’s commencing work thereon. Any such agreement shall be made within the time frame specified in the notice. Any agreement shall require that the premises be left in a condition that is clean, safe and sanitary, all subject to the approval of the Director of Public Safety and Service;
      (4)   Requiring that the building or the unsafe portion thereof be vacated prior to expiration of the time frame specified in the notice; and
      (5)   In the case of an owner of record and a vendee under a recorded land contract, the notice shall further include an order that the owner or vendee shall abate the nuisance within the time frame specified in the notice.
