§ 70.49 SPECIAL REGULATIONS IN CONGESTED DISTRICT.
   (A)   (1)   The congested district shall be included within the following boundaries. All the areas bounded by the following streets shall be considered the congested areas and this section shall apply to the area. The area bounded on the west by the side of Second Avenue between the east side of Second Avenue between Second Street south and Franklin. The area shall be bounded on the north by the north side of Franklin Avenue between the east side of Second Avenue west and each side of Broadway and shall be bounded on the east by the east side of Broadway between the north side of Franklin Avenue and First Street, at which point the boundary shall run east on the north side of First Street SE to the west side of First Avenue SE. From whence it shall run south to the south side of Second Street SE and thence west along the south side of Second Street south to the east side of Second Avenue SW.
      (2)   The City Council may establish by resolution no truck parking zones in the congested district and shall mark by appropriate signs any zones so established. The zones shall be established in the congested district where heavy traffic by commercial vehicles or other vehicles congestion makes parking by commercial vehicles a hazard to the safety of vehicles or pedestrians. No person shall park a commercial vehicle of more than 1-ton capacity between 8:00 a.m. and 6:00 p.m. on any weekday upon any street in any no truck parking zone, but parking of the vehicle for a period of not more than 30 minutes shall be permitted in the zones for the purpose of having access to abutting property when the access cannot conveniently be secured from an alley or from a side street where truck parking is not so restricted.
      (3)   The City Council by resolution may establish in each block in the congested districts 1 or more loading zones and shall mark by appropriate signs any zone so established. The zones shall be located at places most convenient for the use of the public with regard to traffic conditions in the block. No person shall, between the hours of 8:00 a.m. and 6:00 p.m. of any weekday, park any vehicle in any loading zone except for the purpose of receiving or discharging passengers or freight and then only for a period no longer than is necessary for the discharge or receipt of passengers or freight.
      (4)   The City Council by resolution may establish both within the congested district and without the hours of parking therein, the length of time the vehicles may be parked without being moved, and may impose a penalty violation of any parking regulations so made by resolution. However, signs shall be erected which clearly indicate the parking restrictions.
      (5)   No vehicle of any kind whether motorized farm equipment or other may be parked on any street in the City of Wells which is for sale or is held by the owner for resale nor shall any vehicle or farm implement dealer so park any vehicles on a street in the City of Wells for sale or resale purposes unless he or she has received from the City Council a written permit to do so.
      (6)   The City Council may by resolution at any time make streets wherein parallel parking is hereby authorized to angle parking or may change angle parking or may change angle parking to parallel and, if the changes are made, the markings or signs shall be placed at the street indicating the mode of parking.
   (B)   It shall be unlawful to park any vehicle in the area designated in division (A) above as congested district for the first 24 hours following a snow storm in the City of Wells. Any vehicle found parked in this area, which interfere with the removal of snow and plowing of the streets may be towed away by the City of Wells, and the towing shall be at the expense of the owner. In areas in the City of Wells outside of the area designated as a congested district, any vehicle remaining parked in the city street for more than 24 hours following a snow storm without being moved shall be towed away and the cost of the towing shall be assessed against the owner of the vehicle and the vehicle shall not be released to the owner until the towing charges have been paid. After any snow storm in the City of Wells, the Street Commissioner or the city police may place signs reading “No Parking, Snow Removal” and designating the time on the streets and when the signs are erected on the streets, no parking shall be permitted in that area. Any vehicles remaining after the signs have been in place for more than 2 hours may be towed away by the City of Wells at the owner's expense.
