(A) Application. The driver, operator, or owner of any motor vehicle or vehicle within the city limits of the City of Wells shall conform to and observe the regulations set forth in this section.
(B) Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
EMERGENCY WEATHER CONDITION. A condition created on public rights-of-way because of the presence of snowfall in excess of 2 inches, freezing rain, sleet, or other natural phenomenon which create or are likely to create hazardous road conditions, and impede the free movement of fire, health, police, emergency, or vehicular traffic.
(C) Declaration of emergency weather condition. The Street Commissioner, or his or her designee, is granted the authority to declare emergency weather conditions. The announcement shall be made over local radio, press, or television. The announcement shall state the time period during which the conditions shall exist. The time period may be extended through a second announcement
(D) Emergency weather parking regulations. During emergency weather conditions it is unlawful to park or leave standing any vehicle on any public street, avenue, or alley until the roadway has been fully and completely (curb-to-curb) cleaned. These parking regulations shall not apply to operators of wreckers or authorized emergency vehicles while actually serving mechanical, fire, medical, or police emergencies.
(E) Removing and impounding vehicles. Any vehicle which is left parked or standing on a public street during an emergency weather condition and in violation of this section is hereby declared a nuisance and shall be subject to a $25 fine or an amount as affixed by the City Council from time to time. The fine imposed on a vehicle pursuant to this section shall not prevent or preclude the institution and prosecution of proceedings for violation of this section against the vehicle owner.
(F) Public notice. Notice of the emergency weather parking provisions shall be published in the official paper prior to November 1, every year. Notice shall also be posted at City Hall at the time of publication.
