(A) Civil penalty. Violation of this chapter shall subject the offender to a civil penalty in the amount of $100 per day the violation continues to be recovered by the town in a civil action in the nature of a debt if the offender does not pay the penalty within 72 hours of receipt of the citation by the offender. A police officer, Noise Control Officer or Animal Control Officer may issue a citation.
(B) Criminal penalty. In addition to, or in lieu of, the civil penalties or other remedies, violation of this chapter shall constitute a misdemeanor, pursuant to G.S. § 160A-175 and G.S. § 14-4, as amended, punishable for each day the violation continues by a fine of up to $500 and/or incarceration for up to 30 days. A police officer or Animal Control Officer may initiate the criminal process.
