8-3-15: TEMPORARY OBSTRUCTIONS; PERMIT REQUIRED:
Whenever any person desires to temporarily place an object or thing on or otherwise obstruct the streets, sidewalk or parkings of the city, he shall first apply to the chief of police of the city for a permit therefor. The chief of police shall charge and receive for said permit, the sum of fifty cents ($0.50) for every three (3) day period, or part thereof, that said obstruction exists. No such permit shall issue by the said chief of police unless the party applying therefor first agrees in writing to indemnify the city against any and all liability which may arise out of the placing of said obstruction by said person. Further, no such permit shall issue if in the discretion of said chief of police, the proposed obstruction will unreasonably obstruct the flow of traffic, either pedestrian or motor vehicle, will be inherently dangerous to life, limb or property, or which will unreasonably obstruct the ingress to or egress from another person's property, or if said obstruction in the discretion of the said chief of police is to remain for an unreasonable length of time.
The chief of police of the city shall regulate and supervise any such obstructions to the end that said obstructions are not extended beyond the authority granted by said permit, and if at any time said obstruction becomes inherently dangerous or a nuisance, it shall be ordered removed by the chief of police.
