7-3-3: PRIVATE WASTEWATER DISPOSAL SYSTEMS:
   A.   Allowed: Where a public sanitary or combined sewer is not available under the provisions of section 7-3-2 of this chapter, the building sewer shall be connected to a private wastewater disposal system complying with the provisions of this section. (Ord. 928, 11-22-1982)
   B.   Permit Required: Before commencement of construction of a private wastewater disposal system, the owner shall obtain a written permit signed by the Southwest health district. The application for such permit shall be made on a form furnished by the district, which the applicant shall supplement by any plans, specifications and other information as are deemed necessary by the Southwest health district. An inspection fee shall be paid to the Southwest health district at the time that the application is filed. (Ord. 928, 11-22-1982; amd. 1987 Code)
   C.   Southwest Health District Inspection: A permit for a private wastewater disposal system shall not become effective until the installation is completed to the satisfaction of the Southwest health district. The district shall be allowed to inspect the work at any stage of construction and, in any event, the applicant for the permit shall notify the Southwest health district when the work is ready for final inspection and before any underground portions are covered. The inspection shall be made within forty eight (48) hours of the receipt of notice by the applicant.
   D.   State Health Department Recommendations: The type, capacities, location and layout of a private wastewater disposal system shall comply with all recommendations of the department of health and welfare of the state. No permit shall be issued for any private sewage disposal system employing subsurface soil absorption facilities where the area of the lot is less than three hundred twenty (320) square feet. No septic tank or cesspool shall be permitted to discharge to any natural outlet.
   E.   Use Of Public Facilities When Available: At such time as a public sewer becomes available to a property served by a private sewage disposal system, a direct connection shall be made to the public sewer in compliance with this chapter, and any septic tanks, cesspools and similar private sewage disposal facilities shall be abandoned and filled with suitable material.
   F.   Owner Responsibility: The owner shall operate and maintain the private wastewater disposal facilities in a sanitary manner at all times, at no expense to the city.
   G.   Additional Requirements: No statement contained in this section shall be construed to interfere with any additional requirements that may be imposed by the department of health and welfare. (Ord. 928, 11-22-1982)
   H.   Time Limit For Compliance: When a public sewer becomes available, the building sewer shall be connected to said sewer within thirty (30) days upon notice from the Southwest Idaho health district and the private sewage disposal system shall be cleaned of sludge and filled with clean, bank run gravel or dirt.
