(A) A certain document, three copies of which are on file in the office of the Village Clerk, marked and designated as the International Fire Code, including all appendix chapters as published by the International Code Council, is adopted as the code of the village for regulating and governing the safeguarding of life and property from fire and explosion hazards, arising from the storage, handling, and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in issuance of permits for hazardous uses or operations; and each and all of the regulations, provisions, conditions, and terms of the International Fire Code, 2018 Edition, published by the International Code Council, on file in the office of the village referred to, adopted, and made a part as if fully set out in this section.
(B) The following sections are revised.
(1) Section 101.1. Title. “These regulations shall be known as the Fire Code of the Village of Webberville, referred to as “this code”.”
(2) Section 109.3. Violation penalties. “Persons who shall violate a provision of this code or shall fail to comply with any of the requirements or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the code official, or of a permit or certificate used under provisions of this code, shall be guilty of a Municipal Civil Infraction, punishable by a fine of not more than $500.00. Each day that a violation continues after due notice has been served shall be deemed a separate offense.”
(3) Section 111.4. Failure to comply. “Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than $100.00 or more than $500.00, for each day such work continues.”
(C) If any section, subsection, sentence, clause, or phrase of this section is, for any reason, held to be unconstitutional, such decisions shall not affect the validity of the remaining portions of this section. The Village of Webberville declares that it would have passed this section, and each section, subsection, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.
(D) The Village Clerk is directed to cause this section to be published.
(E) This section, and the rules, regulations, provisions, requirements, orders, and matters established and adopted, shall take effect and be in full force and effect immediately from and after the date of its publication.
