(A) No person shall construct, install, maintain, or operate a cable communications system in the village nor shall any person provide cable communications service or acquire ownership or control of a cable communications company providing the service in the village without having first obtained a franchise therefor from the village and executing a franchise agreement with the village in accordance and compliance with all of the terms of this chapter.
(B) No person shall use, occupy, or traverse streets, alleys, lanes, avenues, boulevards, sidewalks, bridges, viaducts, rights-of-way, or any other public place or public way in the village or any extensions thereof or additions thereto, whether on, above, or under the surface of the ground, for the purposes of installing, constructing, maintaining, or operating a cable communications system or facilities therefor or for the purposes of installing, constructing, maintaining, or operating a cable communications system or facilities therefor or for the purpose of furnishing a cable communications service without the person having first obtained a franchise therefor from the village and executing a franchise agreement with the village in accordance and compliance with all of the terms of this chapter.
