§ 111.05  CARRIAGE AND OPERATOR RESTRICTIONS.
   (A)   Carriage companies must abide by any order given by the Public Safety Director, police officer, or any village department having jurisdiction.
   (B)   In the central business district, animal carriages may only use carriage stands designated by Village Council to load or unload passengers.
   (C)   Horse drawn vehicle drivers must have a valid driver’s license issued by the State of Ohio, Commonwealth of Kentucky, or the State of Indiana for the duration of the private vehicle license period.
   (D)   Each horse drawn vehicle operator must have, on file with the Police Department, a written copy of its training program used for training and certifying drivers.
   (E)   Each driver must file a sworn affidavit that he or she has successfully completed an apprenticeship of 40 hours with the horse drawn vehicles/carriages or has previous experience exceeding 40 hours therein, which includes, but is not limited to:
      (1)   The proper method of fitting a harness to a horse and hitching/unhitching a properly harnessed horse;
      (2)   Has ridden with a licensed driver for the first 24 hours of the apprenticeship to observe the proper handling and driving of a horse drawn vehicle and has been trained in emergency situations for unexpected animal behavior;
      (3)   Has driven the horse drawn vehicle under the supervision of a licensed driver for the last 16 hours of the apprenticeship in downtown traffic;
      (4)   The affidavit must state whether the driver is trained for single or team horse operation; and
      (5)   The affidavit must state who conducted the training program and what his or her qualifications are.
   (F)   Horse drawn vehicle/carriage drivers shall travel only those boundaries as designated for horse drawn vehicle/carriage travel, including special occasion travel routes as approved by the Director or his designee.
   (G)   Horse drawn vehicles/carriages are prohibited from traveling in the village between the hours of 1:30 a.m. and 9:00 a.m. There shall be no exceptions.
   (H)   Horse drawn vehicles/carriages are prohibited from traveling in the village between the hours of 3:00 p.m. and 6:00 p.m., Monday through Friday, except on national legal holidays.
   (I)   No driver shall operate a vehicle/carriage while under the influence of intoxicating beverages or drugs.
   (J)   No person may consume edibles (including soft drinks), drink any alcoholic beverage, or be intoxicated as defined by law while such person is operating or being transported by horse drawn vehicles/carriages, nor may any passenger carry, possess, or have any alcoholic beverage while being transported by horse drawn vehicles/carriages, except in the original package with the seal unbroken, in the village.
   (K)   The driver shall observe and obey all traffic laws and regulations of the village and state.
   (L)   No driver shall abandon his or her vehicle/carriage, permit any unlicensed driver to drive for him or her, except an apprentice, or permit any passenger to ride on the driver’s seat.
   (M)   Drivers shall never permit the seating capacity rated for his or her vehicle/carriage to be exceeded.
   (N)   The licensee shall not permit vehicles/carriages to travel village streets unless the following is adhered to.
      (1)   Each vehicle/carriage with a seating capacity of one to 16 passengers, including the driver and guide, may be operated by one or more horses.
      (2)   Each vehicle/carriage with a seating capacity from 17 to 24 passengers, including driver and guide, shall be operated with not less than two horses.
      (3)   Each vehicle/carriage with a seating capacity from 25 to 50 passengers, including driver and guide, shall be operated with not less than four horses.
   (O)   No passenger shall be permitted to stand or ride on any part of the vehicle/carriage while in motion. Drivers shall take all necessary precautions to prohibit such activity. All passengers must be seated except when loading or unloading.
   (P)   Drivers are prohibited from smoking while carrying passengers for optimum safety and control of the horse drawn vehicle/carriage and for the safety of its occupants.
   (Q)   The driver of each horse drawn vehicle/carriage during travel from one-half hour after sunset, and at all such other times as conditions exist for poor visibility, shall cause the front lights and tail lights of the vehicle/carriage to be in operation.
   (R)   The driver of each horse drawn vehicle/carriage upon approaching or exiting a bridge, or during travel on a bridge, shall have the yellow lights flashing in a continuous fashion.
   (S)   The driver shall not permit the speed at which any horse drawn vehicle/carriage is driven to exceed a slow trot.
   (T)   Each vehicle/carriage must be maintained so as to ensure the safety of its patrons and employees.
   (U)   Each vehicle/carriage must be equipped with a device to catch horse manure from falling to the pavement for later disposal upon return to the base of operations.
   (V)   Each vehicle/carriage will be equipped with a chemical to be poured over horse urine by drivers so as to breakdown and eliminate accumulated agents and odors.
   (W)   Each vehicle/carriage will be equipped with a slow moving vehicle emblem required by § 74.12 and R.C. § 4513.11 to be attached to the rear of the vehicle.
   (X)   Sufficient reflective material must be placed along the shafts of the vehicle/carriage, or other parts thereof, which normally parallel the body, head, or legs of the horse pulling such vehicle/carriage.
   (Y)   A fully charged backup battery must be carried on each vehicle/carriage during travel away from the base operation to meet emergency situations due to failure of the primary battery. If there is no room on the carriage for a backup battery, one must be readily available by the carriage stands.
