§ 94.051 CLEANING AND REPAIR.
   (A)   (1)   It shall be the duty of the owner or occupant of any parcel of land in the village abutting on streets, alleys, and public ways of the village where sidewalk, curb, gutter, or driveway has been constructed to keep such improvement in good repair in accordance with the specifications set forth herein.
      (2)   The owner or occupant shall cause such sidewalk to be kept free of accumulations of rubbish, mud, ice, or snow. He or she shall also cause such sidewalk, curb, gutter, or driveway to be kept level and safe for pedestrians and others who are entitled to use it. Trees, bushes, and hedges located on private property shall be kept trimmed by the property owner or occupant so that they do not interfere with the use of the sidewalks. Retaining walls, ditches, and fences shall be kept in repair and adequately safeguarded to prevent injury to users of the sidewalk.
   (B)   In furtherance of the obligation of the owner or occupant of land within the village to repair, pave, or repave sidewalks, curbs, or gutters, as stated in division (A) of this section, such owner or occupant shall cause such sidewalks, curbs, gutters, or driveways to be placed in good and safe condition through repairing, paving, or repaving within 21 days after the Building and Zoning Code Enforcement has directed the same to be done.
   (C)   The Building and Zoning Code Enforcement Officer shall issue repair notices to owners or occupants of real estate whose sidewalks, curb, gutter, or driveway are in violation of the provisions of this section. Such notice to repair, pave, or repave sidewalks, curb, gutter, or driveway shall require such work to be accomplished within 21 days from the date of such notice.
   (D)   Any owner, occupant, or other person who shall take up, or cause to be taken up, the whole or any part of any paved sidewalk, curb, gutter, or driveway for the purpose of improvement or otherwise shall cause such sidewalk, curbs, gutter, or driveway to be relaid in accordance with the specifications set forth herein within 21 days.
   (E)   The Council of the village shall cause the repair, paving, or repaving of all sidewalks, curb, gutter, or driveway of those properties found to be in violation of the provisions of division (B), (C), or (D) of this section and shall present to the owners of such properties for payment such administrative, construction, and other charges as may be incurred in making such repairs, paving, or repaving.
   (F)   Whoever neglects or refuses to fulfill the obligations imposed by this section within the time prescribed shall be fined not more than $50 for each offense. A separate offense shall be construed to mean every seven-day period such violation continues after the initial offense.
   (G)   Whoever fails or refuses to pay the charges incurred under division (E) of this section upon presentation of the same by the Village Clerk shall be fined not more than $500.
