(A) Any corporate entity, individual, or partnership that desires to distribute advertising materials or free newspapers or free periodicals within the village must obtain a permit from the village prior to distributing same.
(B) (1) The application for the permit shall set forth the name, address, and telephone number of the entity or individual seeking the permit. In addition, the applicant for the permit shall recite who is to be distributing the materials within the village.
(2) If the items are distributed by throwing them from a moving vehicle, proof of liability insurance of $250,000 for each person and $500,000 per accident must be provided and maintained throughout the holding of any permit.
(3) All applicants must acknowledge that its applicants, agents, or employees shall obey all traffic laws, including staying within marked lanes.
(4) It is expressly prohibited by this section to attempt to avoid its effect by the use of independent contractors. Any entity, firm, or individual obtaining a permit shall be responsible for the actual distribution of the materials.
(C) (1) The village shall make available upon request the name, address, and telephone number of any distributor holding a valid permit to circulate within the village.
(2) Any citizen, partnership, or corporation within the village, be they a property owner or tenant, may contact the distributor named on any advertising permit for the purpose of advising the distributor to cease delivery of any unwanted materials to a home or business. Upon receiving such a request, the distributor shall immediately cease delivery of unwanted items.
(3) In the event a distributor fails to cease delivery of items after receipt of a request to do so, the Village Manager may suspend, revoke, or refuse to renew the permit to advertise of said distributor.
(D) The initial permit shall be $100 and cover a period of 365 days. All permit holders shall reimburse the village the sum of $15 for each certified mail notice.
(E) Nothing contained within this section shall apply to political advertising, local school circulators, charitable organizations, or non-profit organizations.
(F) Whoever violates any provisions of this section shall be punished by way of a fine of not more than $100 per day for each offense.
