(a) No owner, operator, or person in control of a motor vehicle shall operate a sound system in, on or around said motor vehicle that is plainly audible fifty (50) or more feet away from said vehicle by a person of ordinary sensibilities.
(b) Whoever violates subsection (a) hereof shall be guilty of a minor misdemeanor on the first offense, a fourth degree misdemeanor if the offender has been previously convicted of a violation of subsection (a) hereof within the last twelve months and a third degree misdemeanor if the offender has been previously convicted of two or more violations of subsection (a) hereof within the last twelve months.
