1309.04 APPEAL FROM DENIAL OF BUILDING PERMIT.
   An applicant whose application for building permit has been denied by the Mayor shall have the absolute right to appeal said denial decision to Council. Said appealing applicant shall submit a written application of appeal directly to the Mayor and shall attach thereto a statement that said Mayor had refused to grant the building permit and the reasons for the denial if known to the applicant. The Mayor shall hear the appeal within thirty (30) days of the date of the filing of the appeal by the aggrieved applicant. Council shall hear the appeal at a regularly scheduled session of Council or may call a special meeting for the purpose of hearing the appeal. Upon completion of the appeal procedure, Council either affirm the rejection of the Mayor for the permit or direct the Mayor to grant the application for the building permit. If the Mayor refuses to grant the building permit upon direction of Council, Council shall issue the building permit to the applicant on its own motion.
