925.08 SANITARY SEWER CHARGES.
   (a)   Sewer Charge; Residents Connected to Water System. There is hereby levied and assessed a sewer charge upon each lot and parcel of land having an active water connection with the Village of Wayne water system.

   (b)   Rates.
      (1)   A monthly sewer charge for any parcel of land situated within the corporation limits of the Village of Wayne and having a connection to the Village potable water system and/or discharging sewage shall be based upon the quantity of water used as measured by the Village water meters and shall be charged to the owner of said parcel as follows:
         A.   A Minimum Base Rate (MBR) of sixteen dollars and fifty cents ($16.50) per parcel served. Such MBR shall be charged irrespective of the amount of usage unless the water supply has been voluntarily discontinued at the property owner’s written request.
         B.   In addition to the MBR described above, there shall be a charge of three dollars and ninety cents ($3.90) for each one hundred (100) cubic feet of water (or fraction thereof) used.
      (2)   Beginning January 1, 2014, the rates prescribed in subsections (b)(1)A. and B. above, shall automatically increase each calendar year by three percent (3%) without further action from Council. The increase shall be calculated by the following formula:
         A.   The previous year’s rate shall be considered the base rate (“BR”).
         B.   Three percent (3%) of the BR shall be added to the BR and rounded up to the nearest $0.05 to calculate the increased effective rate for the subsequent calendar year.
   Thus, by way of example, and without limitation, the effective rate for the charge contemplated under subsection (b)(1)A. above, beginning January 1, 2014 shall be seventeen dollars ($17.00).
   (c)   Private Water Systems.  
      (1)   A monthly sewer charge for any parcel of land situated within the corporation limits of the Village of Wayne not having a connection to the Village potable water system but discharging sewage shall be based upon the quantity of water used from any and all private wells or other sources of potable water which serve said parcel, as measured by a water meter approved by the Village prior to installation, but purchased and installed at the sole expense of the property owner and shall be charged to the owner of said parcel as follows:
         A.   A Minimum Base Rate (MBR) of sixteen dollars and fifty cents ($16.50) per parcel served. Such MBR shall be charged irrespective of the amount of usage.
         B.   In addition to the MBR described above, there shall be a charge of three dollars and ninety cents ($3.90) for each one hundred (100) cubic feet of water (or fraction thereof) used.
      (2)   Beginning January 1, 2014, the rates prescribed in subsection (c)(1)A. and B. above, shall automatically increase each calendar year by three percent (3%) without further action from Council. The increase shall be calculated by the following formula:
         A.   The previous year’s rate shall be considered the base rate (“BR”).
         B.   Three percent (3%) of the BR shall be added to the BR and rounded up to the nearest $0.05 to calculate the increased effective rate for the subsequent calendar year.
Thus, by way of example, and without limitation, the effective rate for the charge contemplated under subsection (c)(1)A. above, beginning January 1, 2014 shall be seventeen dollars ($17.00).
   (d)   Deposit. A deposit of fifty dollars ($50.00) shall be required for any new service to a property. Said deposit shall be held for a maximum of twenty-four (24) months and shall accrue no interest, but shall be returned to the person who made the deposit upon the soonest occurring of the following and upon the following terms:
      (1)   At the time the sewer service is terminated, less any outstanding balance owed to the Village for sewer charges; or
      (2)   After twenty-four (24) months, the deposit shall be returned in full.

   (e)   Penalties.  
      (1)   Any bill not paid by the fifteenth (15th) of the month following the regular billing cycle shall be considered delinquent, and a penalty of ten percent (10%) of the outstanding balance shall be assessed thereon after the twentieth (20th) day of that month.
      (2)   For sewer charges that remain unpaid for a period exceeding three (3) months, the Village at its discretion shall cease providing both water and sewer service to said land parcel by shutting off those services. Said action shall be duly documented by the Village in their records, and a notice of said action shall be sent to the registered owner of said property by regular US Mail, accompanied by a certificate of mailing.
      (3)   Service shall be resumed to the property upon receipt in full of the past due water and sewer charges, and payment of a $50.00 reconnect fee. The decision to allow any other settlement arrangements shall be determined by the Village Council in regular session. Property owners shall be held responsible for all sewer bills, and any unpaid balances are subject to being made liens against such property.

   (f)   Funds Generated. All funds generated after the sewer system acceptance shall be segregated and placed in the Village Sanitary Sewer Account and shall be used solely for the costs of operating, the debt service and a reserve.
