11-3-1: VARIATIONS:
The Village Board may authorize a variation from these subdivision regulations after review of the findings and recommendations of the Plan Commission when, in its opinion, undue hardship may result, or the public interest will not be served by strict compliance with such regulations and the goals of this Title may be thereby furthered. In granting any variation, the Plan Commission may recommend and/or the Village Board may prescribe such conditions deemed necessary to, or desirable for the public interest. No variation shall be granted unless the Village Board finds:
   A.   That there are special circumstances or conditions affecting said property, such that the strict application of the provisions of this Title would frustrate or impair the creation of a quality development.
   B.   That the granting of the variation will not be detrimental to the public welfare or injurious to other property in the area in which said property is located. (Ord. 91-21, 8-6-1991)
