6-2-7: NONLICENSED MOTOR VEHICLES:
   A.   Definitions:
    ALL-TERRAIN VEHICLE: A motor vehicle which is all of the following:
      1.   Designed for operation off of the highway by an operator with no more than two (2) passengers;
      2.   Fifty inches (50") or less in width;
      3.   Six hundred (600) pounds or less unladen weight;
      4.   Suspended on three (3) or more low pressure tires;
      5.   Has a single seat designed to be straddled by the operator;
      6.   Has either a driving wheel or handlebars for steering control.
   NONLICENSED MOTOR VEHICLE: A minibike, motorized vehicle, all-terrain carrier, snowmobile, miniature auto, go-cart or any vehicle designed to carry a person or persons other than an automobile, truck or tractor.
   OPERATE: To ride in or on, use, or control a nonlicensed motorized vehicle in any manner.
   PERSON: Any individual, firm, partnership, association, corporation, governmental agency, club or organization of any kind. (Ord. 86-07, 10-13-1986; amd. 1998 Code)
   B.   Prohibited Uses: It shall be unlawful for:
      1.   Any person to drive or operate any unlicensed motor vehicle in a careless, reckless or negligent manner;
      2.   Any person to operate any nonlicensed motorized vehicle within the village between the hours of ten o'clock (10:00) P.M. and eight o'clock (8:00) A.M., daily;
      3.   A parent, legal guardian, or other person to knowingly permit any person in his custody or control under the age of eighteen (18) years to violate any provision of this section;
      4.   Any person to drive or operate any nonlicensed motorized vehicle on the streets, alleys, rights of way or public property within the village;
      5.   Any person to drive, operate or use any nonlicensed motorized vehicle on private property within the village without the consent of the owner or leasee of the said private property. (Ord. 86-07, 10-13-1986)
   C.   Penalty: Any person who shall be convicted of violating any provision of this section shall be fined as provided in section 1-4-1 of this code for each offense. (Ord. 16-03, 5-17-2016)
