6-2-2-3: PARKING RESTRICTIONS:
   A.   Parking Prohibited In Specified Places: No person shall park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control device, in any of the following places:
      1.   On a sidewalk;
      2.   In front of a public or private driveway;
      3.   Within an intersection;
      4.   On a crosswalk;
      5.   Within twenty feet (20') of a crosswalk;
      6.   Within thirty feet (30') upon the approach to any flashing beacon, stop sign or traffic control signal located at the side of a roadway;
      7.   Within fifty feet (50') of the nearest rail of a railroad grade crossing;
      8.   Alongside or opposite any roadway excavation or obstruction when such parking would obstruct traffic;
      9.   On the roadway side of any vehicle parked at the edge or curb of a street;
      10.   Upon any bridge or other elevated structure upon a highway;
      11.   At any place where official signs prohibit parking;
      12.   In the front yard of any lot, except on the driveway portion thereof;
      13.   On that portion of any publicly or privately dedicated street lying between the property line and the improved portion of said street, commonly referred to as "the parkway", without the permission of the person or entity owning or controlling such street;
      14.   At any place designated as a fire lane;
      15.   At any place where the street or curb is painted yellow.
No person other than a police officer shall move a vehicle into any such prohibited area or away from a curb or shoulder such distance as is unlawful or start or cause to be started the motor of any motor vehicle, or shift, change, or move the levers, brake, starting device, gears, or other mechanism of a parked motor vehicle to a position other than that in which it was left by the owner or driver thereof, or attempt to do so.
   B.   No Parking Zones Enumerated: It shall be unlawful for any person to park a vehicle in any of the following designated places at any time:
Railroad Street, on the east side thereof, between the U.S. postal service parking lot and Army Trail Road.
Railroad Street, on the west side thereof, between the police station and the southerly limits of the village hall/police station site.
   C.   Standing Of Vehicles Restricted For Specified Places: During the times specified in this section it shall be unlawful for the driver of a vehicle to stand a passenger vehicle for a period of time longer than is necessary for the loading or unloading of passengers, not to exceed three (3) minutes, and for the driver to stand any service or delivery vehicle for a period of time longer than is necessary to load, unload or deliver materials, not to exceed thirty (30) minutes, in any of the following places:
   Billy Burns Road - along its entire length.
   Cedar Lane - along its entire length.
   Elm Road - along its entire length.
   Glos Street - that portion west of Guild Lane.
   Orchard Lane - along its entire length.
   Pearson Lane - along its entire length.
   Pratt Road - along its entire length.
   Will Way - along its entire length.
   D.   Special Parking Permits: The chief of police shall, upon application, issue special parking permits to residents of the roads enumerated in subsection C of this section only, not more than four (4) times each year, for use on a specific date only, allowing the parking of vehicles on such road for private, noncommercial purposes such as, but not limited to, picnics, parties, family reunions or similar activity. The chief of police shall not issue any permits for such parking unless he shall first determine that the number and proposed location of vehicles to be parked in the road right of way will not constitute a hazard or obstruction to the free and uninterrupted passage of emergency vehicles. No overnight parking of vehicles shall be permitted under any circumstances. All such special permits shall expire not later than eleven fifty nine o'clock (11:59) P.M. on the date for which they are issued. The chief of police shall issue the permits provided for under this section without charge or fee.
   E.   Parking During Snow Emergencies:
      1.   Parking Restricted:
         a.   Parking After Snowfall: It shall be unlawful to stand or park any vehicle for a period of time longer than five (5) minutes for the loading and unloading of passengers, or thirty (30) minutes for the loading, unloading, pick up or delivery of materials from commercial vehicles within the pavement or on the shoulder of any public road in the village at any time the snow on the street exceeds three inches (3") or more in depth (2 inches or more on designated snow emergency routes) and until the snow stops falling and for the necessary period of time until all snow removal operations have been completed.
         b.   Parking After Snow Forecast: It shall be unlawful to stand or park any vehicle for a period of time longer than five (5) minutes for the loading or unloading of passengers, or thirty (30) minutes for the loading, unloading, pick up or delivery of materials from commercial vehicles within the pavement or on the shoulder of any public road in the village between the hours of ten o'clock (10:00) P.M. and seven o'clock (7:00) A.M. immediately following any publicly broadcast U.S. weather service forecast for overnight snow accumulation of three inches (3") or more.
      2.   Designated Snow Emergency Routes: The following roads within the corporate limits of the village are hereby designated as snow emergency routes:
Army Trail Road
   Country Club Road
   Dunham Road
   Illinois State Route 25
   Illinois State Route 59
   Munger Road
   Powis Road
   Smith Road
   Weber Drive
This section shall supersede any applicable regulations of the county of Kane, the county of DuPage or the state of Illinois on highways under county or state jurisdiction only to the extent permitted by law.
      3.   Posting Signs: The public works department is hereby authorized and directed to erect and maintain signs at the village limits and other appropriate points within the village providing notice to the public that parking or standing of vehicles is prohibited in snow emergencies as provided by this section.
      4.   Towing Of Unlawfully Parked Vehicles: If the chief of police or his designee shall determine that any vehicle is unlawfully parked in violation of this section after an actual accumulation of three inches (3") or more of snow (2 inches on designated snow emergency routes) and if the presence of such vehicle will impede the safe or efficient plowing of the street, he may direct such vehicle to be towed to a safe and secure location. The registered owner of any such vehicle towed in accordance with the provisions of this section shall be liable for all towing or storage costs, in addition to any fine otherwise payable for a violation of this section. Notice of the towing of any unlawfully parked vehicle shall be given as soon as practicable (but in no case more than 48 hours after towing) by personal delivery to the registered owner thereof (if to a residence within the corporate limits of the village), and by certified mail, return receipt requested, stating the time and date of the offense, the description, serial number and license tag of the vehicle, the location to which the vehicle was removed, and the amount, if known, of towing charges.
   F.   Establishment Of Time Limit Parking Areas: Time limit parking spaces may be established by ordinance passed by the board of trustees. Upon occupying a time limit parking space, such space may be lawfully occupied by such vehicle for the time period designated in this section 6-2-2 and so posted on appropriate signs. If any vehicle remains parked in any parking space beyond the parking time limit as fixed by this section 6-2-2 and the posted signs, it shall constitute illegal parking and the vehicle shall be considered parked overtime.
   G.   Time Limit Parking Areas Enumerated: It shall be unlawful for any person to park a vehicle in any of the following places for a consecutive period of time longer than indicated in this section:
FIFTEEN MINUTE PARKING
Those parking spaces designated "Fifteen Minute Parking" by the posting of signs or marking of the pavement in lot M-1, sometimes referred to as village hall parking lot, situated on the west side of Railroad Street, north of Wayne village hall.
   H.   Unauthorized Use Of Parking Places Reserved For Handicapped Persons: It shall be unlawful to park any motor vehicle which is not bearing registration plates or decals issued to a handicapped person as evidence that the vehicle is operated by or for a handicapped person, in any parking place, including any private or public off street parking facility, specifically reserved, by the posting of an official sign for the motor vehicles bearing such registration plates or decals.
   I.   Parking Of Commercial Vehicles In Residential Areas Prohibited: It shall be unlawful for any person to park a commercial vehicle on any public road, street or way located within a single-family or multiple-family residential zoning district except when making a delivery or rendering a service at premises located within such zoning district. For purposes of this section, "commercial vehicle" shall be as defined in section 1-111.8 of the Illinois vehicle code and having a gross vehicle weight in excess of eight thousand (8,000) pounds.
