3-3-11: SOLICITATION OF CONTRIBUTIONS:
   A.   There is hereby expressly permitted solicitation of contributions from the occupant of any vehicle or pedestrian on the public rights of way within the village of Wayne upon the following terms and conditions:
      1.   The soliciting agency shall be registered with the attorney general as a charitable organization as provided by "an act to regulate solicitation and collection of funds for charitable purposes, providing for violations thereof, and making an appropriation therefor".
      2.   The soliciting agency shall be engaged in a fundraising activity for which a permit has been obtained from the village of Wayne. Said permit shall be issued by the village clerk's office and limited to fifteen (15) fundraising activities each calendar year, of one or two (2) consecutive days each, limited from six o'clock (6:00) A.M. to six o'clock (6:00) P.M. during that time designated as Central Standard Time or six o'clock (6:00) A.M. to eight o'clock (8:00) P.M. during that time designated as daylight saving time. A permit for a two (2) day fundraising activity shall be issued only if the second day of that fundraising activity is a Saturday. Said permit shall be issued by the village clerk on a first come first served basis. Each agency shall be limited to one permit annually.
      3.   The soliciting agency shall furnish to the village of Wayne a certificate of insurance indemnifying the village from any injury to any person or property during the solicitation which is causally related to an act of ordinary negligence of the soliciting agency. Any person engaged in the act of solicitation shall be sixteen (16) years of age or more and shall be wearing a high visibility vest.
      4.   Solicitation shall be permitted only at intersections where all traffic is required to come to a full stop.
      5.   Permits shall be granted to local eleemosynary or religious organizations or to local chapters of national eleemosynary or religious organizations which have been in existence for not less than one year.
      6.   Any violation of this section shall be grounds to deny a permit in the following year, in addition to the penalty set forth in section 1-4-1 of this code. (Ord. 03-12, 7-1-2003)
