A. Meeting Procedures:
1. Meeting Schedule: The dates of the regular meetings of the zoning board of appeals shall be as set forth in the annual meeting schedule or at the call of the chair and as such other times as the board may determine 1 . (Ord. 02-14, 8-20-2002)
2. Open Public Meetings: All meetings of the board shall be open to the public, at which time every person has the right to be heard or to be represented by a duly authorized agent or attorney.
3. Records: The board shall keep minutes of its proceedings, showing the vote of each member upon every question, or if absent or failing to vote, indicating that fact, and shall also keep records of its examinations and other official actions. In every case the board shall include in its official report the reasons a request for a variation is granted or denied. Every rule, regulation, every amendment or repeal thereof, and every order, requirement, decision or determination of the board shall immediately be filed in the office of the village clerk and shall be of public record.
4. Testimony Of Witnesses: All testimony by witnesses at any hearing provided for in the zoning ordinance 2 shall be given under oath. The chairman, or in his absence the acting chairman, may administer oaths and compel the attendance of witnesses.
B. Voting: The concurring vote of four (4) members of the zoning board of appeals shall be necessary to reverse any order, requirement, decision or determination of the zoning enforcement officer, or to decide in favor of the applicant on any matter upon which it is authorized by the zoning ordinance to render a decision. The zoning board of appeals shall make no recommendations except in a specific case and after public hearing.
C. Rules Of Procedure: The zoning board of appeals shall adopt and publish in pamphlet form rules of procedure for the conduct of its business. Such rules of procedure shall be subject to approval of the village board and shall not be inconsistent with any of the provisions of the zoning ordinance. (Ord. 89-13, 5-16-1989)
