§ 156.491 SWIMMING POOLS.
   (A)   Types of pools and locations.
      (1)   Public swimming pools. A public pool in any district may not be located within less than 200 feet of any other lot in any R district.
      (2)   Private swimming pools. A private pool may be located anywhere on the premises, except in required front yards; provided, it shall not be located closer than ten feet to any property line of the property on which located; and, provided that, pump and filter installation shall not be located closer than 20 feet to any such property line.
      (3)   Farm pond or stock tank. A farm pond or stock tank shall not be considered to be a swimming pool; however, if such an installation is used for commercial recreational purposes, then, it shall be classified as a swimming pool.
   (B)   General requirements. All swimming pools must comply with the following requirements.
      (1)   The swimming pool, or the entire property on which it is located, shall be so walled or fenced as to prevent uncontrolled access by children from the street or from adjacent properties.
      (2)   Adequate provision for drainage shall be made subject to approval by the County Surveyor.
      (3)   Any lighting used to illuminate the pool area shall be so arranged as to deflect the light from adjoining properties.
      (4)   No person, firm or corporation shall construct or install a swimming pool or make any alteration thereon or in the appurtenances thereof without having first obtained an improvement location permit for such construction, installation or alteration.
