§ 156.422 LEVEL 3 HOME OCCUPATION.
   (A)   Where permitted. Residential use properties within the A-1, A-2, C-1, and C-2 zone districts, except:
      (1)   Within a platted subdivision with two or more lots; or
      (2)   Where restrictive covenants prohibit such use.
   (B)   Definition. A Level 3 home occupation is a service trade in which a dwelling and/or accessory structure is used as the only place of operation for the business, and which meets all the following conditions:
      (1)   The home occupation is operated by residents of the dwelling only.
      (2)   The home occupation provides its services on-site to customers who bring items to the business.
      (3)   The home occupation service is limited to those listed in this section.
      (4)   The home occupation is clearly secondary to the residential use of the property.
      (5)   The home occupation does not change the residential character of the property or the zone district's character or function.
      (6)   The home occupation must meet the requirements of the development standards of this section.
   (C)   Development standards.
      (1)   Level 3 home occupation operations must meet:
         (a)   For Zone Districts A-1 and A-2, the minimum lot area, width, and yard requirements for other permitted uses.
         (b)   For Zone District C-1, the minimum lot area, frontage, and yard regulations for residential uses.
         (c)   For Zone District C-2, the minimum lot area, frontage, and yard requirements for residential uses.
      (2)   Level 3 home occupation operations are limited to:
         (a)   No more than 25% of the dwelling;
         (b)   An attached garage; and/or
         (c)   A maximum 2,400 square foot, permitted, detached accessory building.
      (3)   Outside storage of any items related to the operation is not permitted, except for road-legal vehicles and hauling trailers used in the business.
      (4)   Limited public access.
      (5)   Retail or wholesale sales are not permitted.
      (6)   A single, double-sided, non-illuminated, sign is permitted.
         (a)   The maximum height of the sign is four feet.
         (b)   The maximum total area of the sign is three square feet (e.g., 18 inches by 24 inches, 12 inches by 36 inches), exclusive of border, trim, base, support, etc.
         (c)   A minimum 30-foot setback from the centerline of any street is required.
         (d)   The sign must not be in a designated right-of-way.
         (e)   The sign must not be located within 25 feet of the side lot line of any adjoining lot in any R-District.
   (D)   List of Level 3 home occupations.
      (1)   A Level 3 home occupation includes:
         (a)   Metal sharpening (sharpening of scissors, knives, axes, saw blades, lawnmower blades, etc.).
         (b)   Soldering, welding, metal working and repair of agricultural related items.
         (c)   Furniture repair and upholstery.
         (d)   Shoe and leather repair.
         (e)   Computer and electronic device repair and customization.
         (f)   Appliance repair.
         (g)   Bicycle repair.
      (2)   The following occupations are not Level 3 home occupations:
         (a)   Metal manufacturing.
         (b)   The repair or manufacturing of vehicles, including upholstery.
         (c)   The manufacturing of furniture, including custom furniture making.
         (d)   Custom woodworking.
         (e)   Shoe or boot making or leather goods production.
         (f)   Computer or electronic device manufacturing.
