§ 165.421 LEVEL 2 HOME OCCUPATION.
   (A)   Where permitted. Residential use properties within the A-1, A-2, C-1, and C-2 zone districts, except:
      (1)   Within a platted subdivision with two or more lots; or
      (2)   Where restrictive covenants prohibit such use.
   (B)   Definition. A Level 2 home occupation is a service trade in which a residential use property is used, in part, as a base of operation for a business, and which meets all the following conditions:
      (1)   The home occupation is operated by residents of the dwelling only.
      (2)   The home occupation provides its services off-site and not at the residence.
      (3)   The home occupation service is limited to those listed in this section.
      (4)   The home occupation is clearly secondary to the residential use of the property.
      (5)   The home occupation does not change the residential character of the property or the zone district's character or function.
      (6)   The home occupation must meet the requirements of the development standards of this section.
   (C)   Development standards.
      (1)   Level 2 home occupation operations must meet:
         (a)   For zone districts A-1 and A-2, the minimum lot area, width, and yard requirements for other permitted uses.
         (b)   For Zone District C-1, the minimum lot area, frontage, and yard regulations for residential uses.
         (c)   For Zone District C-2, the minimum lot area, frontage, and yard requirements for residential uses.
      (2)   Level 2 home occupation operations are limited to:
         (a)   No more than 25% of the dwelling; and/or
         (b)   An attached garage.
      (3)   A maximum 2,400 square foot, permitted, detached accessory building. Outside storage of any items related to the operation is not permitted, except for road-legal vehicles and hauling trailers used in the operation.
      (4)   Non-resident employees are not permitted to work on the property.
         (a)   Off-site, non-resident employees are permitted to pick-up and drop off items for the Level 2 home occupation operation.
      (5)   Retail or wholesale sales are not permitted.
      (6)   Public access is not permitted.
      (7)   Signage is not permitted.
   (D)   List of Level 2 home occupations. A Level 2 home occupation includes:
      (1)   Construction trade contractors;
         (a)   Building and carpentry;
         (b)   Cement or concrete;
         (c)   Masonry (i.e., brick, block, stone);
         (d)   Roofing;
         (e)   Siding and guttering;
         (f)   Painting;
         (g)   Electrical;
         (h)   Plumbing;
         (i)   HVAC;
         (j)   Refrigeration.
      (2)   Lawn maintenance provider;
      (3)   Exterminator and pest control;
      (4)   Satellite dish installer; and
      (5)   Other occupations that provide services off-site.
