§ 156.420 LEVEL 1 HOME OCCUPATION.
   (A)   Where permitted. Residential use properties within the Agricultural, Residential, Commercial, and Industrial districts.
   (B)   Definition. A Level 1 home occupation is a skilled service offered to clients within a dwelling, and which meets all the following conditions:
      (1)   The service is provided by only one resident of the dwelling.
      (2)   The practitioner is limited to no more than one paid assistant.
      (3)   The home occupation service is limited to those listed in this section.
      (4)   The home occupation is clearly secondary to the residential use of the property.
      (5)   The home occupation does not change the residential character of the property or the zone district's character or function.
      (6)   The home occupation must meet the requirements of the development standards of this section and the zone district regulations.
   (C)   Development standards.
      (1)   A Level 1 home occupation is limited to no more than 25% of the floor area of the dwelling.
      (2)   No retail or wholesale sales are permitted.
         (a)   Exception: The retail sale of items commonly sold by a chiropractor, photographer, beautician, or barber is permitted.
      (3)   Exterior signage is limited to a single name plate affixed to the dwelling.
         (a)   Signage is limited to no more than two square feet in area (e.g., 16 inches by 18 inches, 12 inches by 24 inches).
   (D)   List of Level 1 home occupations.
      (1)   A Level 1 home occupation includes:
         (a)   Medical practitioner (i.e., physician, surgeon, dentist, chiropractor);
         (b)   Mental health practitioner (i.e., psychiatrist, psychologist);
         (c)   Family/marriage counselor;
         (d)   Licensed massage therapist;
         (e)   Lawyer;
         (f)   Photographer;
         (g)   Real estate professional (i.e., agent, broker, appraiser);
         (h)   Insurance agent;
         (i)   Financial advisor/tax consultant;
         (j)   Tax preparer;
         (k)   Tailor;
         (l)   Beautician or barber;
         (m)   Instructor/tutor in the liberal arts and/or performing arts (limited to a single student at a time); and
         (n)   Other skilled or professional occupation.
      (2)   The following occupations are not Level 1 home occupations:
         (a)   Group instruction of the liberal arts and/or performing arts;
         (b)   Tea room;
         (c)   Tourist home or bed-and-breakfast;
         (d)   Real estate office (more than one agent, broker, or appraiser);
         (e)   Convalescent home;
         (f)   Mortuary establishment;
         (g)   Store, trade, or business of any kind not herein excepted.
