§ 32.05 SHERIFF’S WORK RELEASE PROGRAM.
   (A)   Deduction limit. As partial payment for room and board provided to the participant by the county, there shall be deducted from the earnings of a participant in the work release program an amount equal to the average daily cost of inmate care (as hereinafter defined); provided that, such deduction shall not exceed 25% of the participant’s gross earnings.

   (B)   Daily cost formula.
      (1)   The average daily cost of inmate care shall be determined by the Sheriff of the county in the following manner:
         (a)   Dividing the total jail budget for the calendar year immediately preceding by 365; and
         (b)   Dividing the quotient obtained in division (B)(1)(a) above by the average number of inmates housed per diem in the County Jail during the calendar year immediately preceding.
      (2)   The Sheriff shall make such determination on or before January 15 of each year. In the event such determination is not made on or before January 15 of any year, the average daily cost of inmate care as determined for the previous year shall continue until a new determination of average daily care of inmate is made as above provided.

   (C)   Funds for Treasurer. All moneys deducted by the Sheriff pursuant to this section shall be remitted to the County Treasurer and deposited in the County General Fund.

   (D)   Sheriff’s responsibility. Except as otherwise provided herein, the County Sheriff shall be responsible for the administration and policy of the work release program.

   (E)   Legal. This section shall be construed in accordance with I.C. 11-12-5-1 et seq.
