(A) The provisions of this chapter are based upon occupancy in the unincorporated areas of the county, and applies to:
(1) The construction, alteration, equipment, use, occupancy, location and maintenance of buildings, structures and appurtenances that are on land or over water and are:
(a) Erected after code takes effect; and
(b) Existing when this code takes effect.
(2) Conversions of buildings and structures or parts of them from one occupancy classification to another;
(3) The movement or demolition of buildings, structures and equipment for the operation of buildings and structures; and
(4) An owner who serves as his or her own general contractor and hires independent contractors to perform a substantial portion of the construction.
(B) Provided, however, this code does not apply to:
(1) Agricultural buildings designed and constructed to house farm implements, hay, grain, poultry, livestock or other horticultural products with such structure not to be a place of human habitation or a place of employment where agricultural products are processed, treated or packaged, nor shall it be a place used by the public;
(2) Private homes that are built, repaired or altered by individuals for their own occupancy; provided, the individual owner and builder has filed in the office of the Plan Department of the county in the administration building:
(a) A location improvement permit issued in accord with Ch. 156 of this code of ordinances by the plan and Zoning Department or the town or city having jurisdiction in a two-mile fringe area; and
(b) A notice of intent to build a private home for occupancy by the builder on forms provided by the Building Commission.
(3) Alterations, additions or repairs to a structure, the cost of which does not exceed $1,000;
(4) Fences; and
(5) Industrialized building systems or mobile Structures certified under I.C. 22-15.4.
