(A) (1) No carrier may transport hazardous materials upon the highways, streets and roads within the unincorporated towns and other unincorporated areas of the county unless the carrier first obtains a certificate from the Director allowing transportation of such hazardous materials.
(2) The Director shall issue a certificate of hazardous waste transport to a carrier if:
(a) Certificates or permits issued by the Interstate Commerce Commission and the Public Service Commission for the transportation of hazardous materials are submitted to the Director; or
(b) The carrier demonstrates to the satisfaction of the Director that it complies and will continue to comply with all laws and regulations of the state and the Federal Government respecting the handling and transport of hazardous materials and the safety of drivers and vehicles.
(B) All applications shall be acted on within 30 days of submission to the Director.
(C) (1) Certificates shall be granted for a period of one year and may be renewed upon application unless revoked for cause after a hearing before the Board of County Commissioners.
(2) Revocation for cause or non- renewal may occur where a certificate holder or applicant fails to comply with any of the requirements of this chapter.
(D) Certificates shall be revocable and non-transferable.
