For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
CARRIER.
(1) Any person that holds himself or herself out to the general public to engage in the transportation by motor vehicle of property, for compensation, whether over regular or irregular routes; or
(2) Any person who engages in transportation by motor vehicle of property, for compensation under contract with one person or a limited number of persons either:
(a) For the furnishing of transportation services through the dedication of motor vehicles for
a continuing period of time to the exclusive use of each person served; or
(b) For the furnishing of transportation services designed to meet the distinct need of each individual customer.
HAZARDOUS MATERIAL.
(1) “Hazardous substance”, as defined in 49 C.F.R. § 171.8;
(2) “Low specific activity material”, as defined in 49 C.F.R. § 173.403(n); or
(3) “Radioactive material”, as defined in 49 C.F.R. § 173.403(y).
TRANSPORTATION. Transportation of hazardous materials or handling and storage for less than 48 hours exclusive of Saturdays, Sundays and holidays whether in commerce or not in commerce.
