§ 36.02 DISHONORED CHECKS.
   (A)   Collection of fee. The Clerk of the Circuit Court may collect a fee of $27.50 from any person who delivers a check or draft to the Clerk which is subsequently dishonored by reason of a stop payment order or insufficient funds.

   (B)   Establishment of Bad Check Fund. The Clerk shall establish a Bad Check Fund and deposit all fees so collected in such fund.

   (C)   Recordkeeping. The Clerk shall maintain such books, records and accounts as may, from time to time, be prescribed in writing by the State Board of Accounts. In the absence of such direction by the State Board of Accounts, the Clerk shall establish such records or accounts as necessary, in the discretion of the Clerk, to properly account for said funds; all of which shall be available at all times for examination by the State Board of Accounts or the Auditor of the county.

   (D)   Fund classification. All funds, so collected, are hereby declared to be general fund miscellaneous; provided, however, that, the Clerk may maintain a balance not to exceed $1,000 for use in redemption of dishonored checks or drafts.

   (E)   Yearly settlement with Auditor. The Clerk on December 1 of each calendar year shall transfer all sums in the Bad Check Fund in excess of $1,000 to the County General Fund, and is authorized to retain in such fund a sum not to exceed $1,000.
