Any residential household or business in the village, which is subject to the charge, upon making application to the Board of Trustees, in writing, which application shall provide that the applicant is furnishing his or her own collection and removal of garbage, refuse, and ashes, which garbage, refuse, and ashes are being disposed of and will in the future be disposed of outside the village in a legal dump site and in full compliance with all statutes of the state and all rules and regulations of any governing body, including, but not limited to, the Environmental Protection Agency, the Department of Health, and the county, and that the applicant will hold harmless and indemnify the village from any claim of damages or penalties which may result from the applicant’s disposal of such garbage, refuse, or ashes and including the village’s attorney’s fees in defending any such action.
