§ 50.36 DELINQUENT BILLS AND DISCONTINUANCE OF SERVICE.
   (A)   In the event payment in full is not received by the village at the Village Hall or in the utility drop box on the tenth day of the month, such utility bill shall be deemed to be delinquent and the utility customer will be sent a notice of delinquency/termination notice. The Village Clerk shall cause such utility customers to be notified, in writing, by first class mail that utility service is to be terminated. Said notice shall also specifically inform the utility customer of the following.
      (1)   The utility customer may contact the Village Clerk to request a hearing on the matter.
      (2)   Said request must be made within five business days of the date of said notice of delinquency/termination notice.
      (3)   If said request is made, a hearing will be held within ten days of the date of said notice of delinquency/termination notice.
      (4)   Utility service will be discontinued ten days from the date of said notice of delinquency/termination notice if no request for a hearing is made.
   (B)   Delinquent utility customers will have until the close of the business on the twentieth day of the month to do the following:
      (1)   Pay the bill in full; and/or
      (2)   Resolve the matter in accordance with the dispute resolution procedure as set forth in this subchapter.
   (C)   If the delinquent utility customer fails to perform one of these requirements by the deadline stated, a disconnect order will be issued by the Village Clerk.
   (D)   Utility service to a residential utility customer shall not be disconnected for nonpayment of bills:
      (1)   On any day when the National Weather Service forecasts for the following 24 hours covering the area in which the residence is located includes a forecast that the temperature will be 32°F or below for the next 24 hours;
      (2)   On any day preceding a holiday or weekend when such a forecast indicates that the temperature will be 32°F or below during the holiday or the weekend; or
      (3)   Not shut off service after 2:00 p.m. unless the village is prepared to reconnect service the same day at the regular reconnection charge.
   (E)   In addition to the village not receiving payment in full, utility service may be terminated for the following additional reasons.
      (1)   The deposit or increased deposit amount was not paid by the due date.
      (2)   The customer benefitted from tampering with village equipment.
      (3)   Access to village equipment was denied.
      (4)   Hazardous health and safety conditions exist.
