1610.13   NON-RESIDENTIAL INSPECTIONS, TESTINGS AND ON-LINE REPORTING CONCERNING LIFE SAFETY SAFEGUARDS.
   (a)   The owners of all non-residential businesses and structures shall be required to provide annual, on-line reporting, in accordance with the system, format and procedures as determined by the Fire Marshal, of all inspections, testing and maintenance records of life safety safeguards as defined in Section 107 of the International Fire Code, as amended.
   (b)   The inspections, testing, maintenance records and reporting as required by paragraph (a) of this section shall be performed and provided at the cost of the owner of the business or structure, by private inspectors who are registered and certified by the City in accordance with paragraph (d) of this section.
   (c)   The first instance of non-compliance with paragraph (a) of this section will require the owner to pay a non-compliance fee, as specified in Wayne City Code Section 1610.15, to cover the costs of follow up efforts necessitated by the non-compliance. Thereafter, any further non-compliance shall constitute a misdemeanor offense.
   (d)   In order to be certified by the City, private inspectors for such life safety safeguards shall be required to apply to the State Fire Marshal, pay a registration fee as specified in Wayne City Code Section 1610.15, and meet such testing and other requirements as determined by the Fire Marshal.
   (e)   The City shall not assume any liability to any person or entity by reason of the inspection or certification of private inspectors required by this section.
