Every permit holder shall observe the following regulations in addition to any special conditions of his or her permit:
(a) No top soil, earth or sand shall be removed, and no excavating shall be carried on, within ten feet of any public street or alley, or within thirty feet of any adjoining property line.
(b) Water, snow or ice shall not be permitted to stand or accumulate in any excavation.
(c) Any excavation in excess of six feet in depth shall be properly fenced with a fence complying with the relevant provisions of these Codified Ordinances.
(d) Within thirty days after completion of the removal of the top soil, earth or sand, or any excavating, pursuant to a duly issued permit hereunder, the applicant shall fill the land to an average grade at least twelve inches above the crown of the lowest road or highway adjacent to or abutting such land, and level the same so as to provide proper drainage suitable for the growing of truf or for other land uses permitted in the district in which such land is situated, and sow suitable grasses thereon. However, in no event shall the applicant be required to fill the land to an average grade higher than that which existed prior to the removal of the top soil, earth or sand from such land pursuant to a permit granted hereunder. Further, in the case of low-lying lands adjoining a river or stream beds, where it clearly appears that the lowering of the level of such lands will not be injurious to adjacent lands or property, or property from which soil, earth or sand is being removed, Council may waive the refilling of such land entirely.
(e) The City, through its duly authorized agents, shall have the right to enter upon any land covered by a permit issued hereunder for the purpose of making inspections and for the purpose of bringing the land into compliance with this chapter if the applicant should fail to do so.
