In order for a permit to be issued for the establishment of a building or a structure in a new location within the City, the building or structure and the proposed new location shall comply with all the Building and Housing Codes and ordinances of the City of Wayne. The establishment of the building shall also comply with the following conditions:
(a) Buildings Not Changed as to Class of Occupancy. The foundations and all new portions of the building or structure shall be constructed in accordance with the applicable Building and Housing Codes and ordinances of the City and all other portions of such building shall be remodeled so that it will substantially comply with the Building and Housing Code and ordinances of the City, as shown on a plan. Front, side and rear yard setbacks for the building in its new location must be of sufficient size to meet the minimum standards required for other buildings of the same class. All rotted, corroded or disintegrated parts of the building or structure shall be repaired or replaced. The building shall be placed in a sanitary condition satisfactory to the Department of Building and Engineering.
(b) Buildings Changed as to Class of Occupancy. In addition to the conditions specified in subsection (a) hereof, all buildings being moved into new locations in the City shall be made to comply with the provisions of this Building and Housing Code and the ordinances of the City governing the class of occupancy planned for such building after the moving operations have been completed.
