809.06 FRANCHISE FEE PAYMENTS BY GRANTEE.
   (a)   A grantee shall pay to the City for use of its streets, public places and other facilities, as well as for their maintenance, improvement and supervision, a franchise fee in an amount equal to five percent of the gross receipts received by the grantee.
   (b)   Late payments shall accrue interest at the highest legal rate.
   (c)   Franchise fee payments shall be in addition to any other tax, charge, fee or payment due to the City from a grantee to the extent consistent with Federal law.
   (d)   Franchise fees shall be disbursed and appropriated by the City Council. The City budget shall include a program or activity line for cable television expenditures. Amounts appropriated by the City for the development of the use of public channels, for production, for the purchase and maintenance of equipment not required to be provided by the grantee, and to cover overhead and other expenses with respect to the regulation of cable television or any franchises granted pursuant to this chapter, shall be included in the program or activity line.
