660.12 THEFT FROM LIBRARIES.
   (a)   Conversion Prohibited. No person shall procure, or take in any way from any public library, whether incorporated or unincorporated, any book, map, chart, painting, pamphlet, picture, photograph, tape recording, record, video tape, film, slide, microfilm, periodical, newspaper, magazine, manuscript, exhibit, or any part thereof, or any other property belonging to the library, with the intent to convert the same to his or her own use or to defraud the owner thereof. No person, having procured or taken any such book, pamphlet, map, chart, painting, pamphlet, picture, photograph, tape recording, record, video tape, film, slide, microfilm, periodical, newspaper, magazine, manuscript, exhibit or any part thereof, or any other property belonging to the library, shall thereafter convert the same to his or her own use or fraudulently deprive the owner thereof. It is presumed that any material checked out under the library card of the person is presumed to have been done so with that person's permission and consent.
   (b)   Failure to Return. No person shall fail to return to the public library or the library, whether incorporated or unincorporated, in accordance with the rules of such library, any book, map, chart, painting, pamphlet, picture, photograph, tape recording, record, video tape, film, slide, microfilm, periodical, newspaper, magazine, manuscript, exhibit or other property belonging to such library. The library shall send a notice to the last known address provided to the Wayne Public Library of the patron who borrowed any book, map, chart, painting, pamphlet, picture, photograph, tape recording, record, video tape, film, slide, microfilm, periodical, newspaper, magazine, manuscript, exhibit or any part thereof upon failure of the patron to return said materials or the reasonable value thereof.
   (c)   Failure to Return by a Minor Child. The parent or legal guardian of a minor child shall be liable under subsection (b) hereof, in the event that his or her minor child fails to return to the public library, whether incorporated or unincorporated, in accordance with the rules of such library, any book, map, chart, painting, pamphlet, picture, photograph, tape recording, record, video tape, film, slide, microfilm, periodical, newspaper, magazine, manuscript, exhibit or other property belonging to the library. The library shall send a notice to the last known address provided to the Wayne Public Library of the parent or guardian of said minor who borrowed any book, map, chart, painting, pamphlet, picture, photograph, tape recording, record, video tape, film, slide, microfilm, periodical, newspaper, magazine, manuscript, exhibit or any part thereof upon failure of the parent or guardian of said minor to return said materials or the reasonable value thereof.
