(a) No person shall possess, sell, offer for sale, distribute, administer, dispense, transport, prescribe or give away any controlled substance or any paraphernalia. The prohibition contained in this subsection shall not apply to those licensed or excepted under the Michigan Public Health Code, being Public Act 368 of 1978, as amended.
(b) No person shall have, possess, sell, offer to sell, dispense or give away any hypodermic syringe, needle, cocaine spoon, marijuana pipe, hashish pipe or other instrument, implement or paraphernalia for the illegal use of a controlled substance by means of subcutaneous or intracutaneous injection, or any other method or manner of introduction, which is possessed, sold, offered for sale, dispensed or given away for that purpose, unless the item was obtained directly from, or pursuant to, a valid prescription or order of a practitioner as defined in Article 7 of the Michigan Public Health Code, being Act 368 of 1978, as amended, while such practitioner is acting in the course of his or her professional practice, or except as otherwise authorized by such Michigan Public Health Code.
(c) No person shall use fraud, deceit, misrepresentation, subterfuge, scheme, device, trick or any other form of concealment of a material fact for the purpose of obtaining any controlled substance or hypodermic syringe or needle or other instrument or implement designed for the administration of controlled substances.
(d) No person shall use fraud, deceit, misrepresentation, subterfuge, scheme, device, trick or any other form of concealment of a material fact for the purpose of obtaining money or any other thing of value by the sale, furnishing, supplying or giving away of any controlled substance represented to be a controlled substance when the same may or may not be a controlled substance.

(e) No person shall knowingly loiter about, frequent, live in or be present in any building, apartment, store, automobile or other place where controlled substances or paraphernalia are sold, dispensed, furnished, given away, stored or kept illegally.
