(a) Failure to complete the record of duty activities required by 49 C.F.R. 398.8 or 49 C.F.R. 395.15, failure to preserve a record of such duty activities, or the making of false reports in connection with such duty activities, shall make the driver or the carrier, or both, liable to prosecution.
(b) A carrier, agent or driver who makes a correction to the hours of service records after submission shall certify as to the accuracy of the record on the corrected record and state the reason for the correction. This certification shall be a legible signature of the carrier official making the correction in addition to the driver certification required in 49 C.F.R. 395.8(d)(5).
