§ 153.190 WIND ENERGY SYSTEMS (WES).
   General standards.
   (A)   No more than one wind energy system (WES) per lot.
   (B)   The height of all WES will be determined by calculating the height from the base of the tower to the highest point of the blades.
   (C)   The WES shall be located to comply with the following minimum setback requirements:
      (1)   From the nearest building: 300 feet or the height of the WES, whichever is greater;
      (2)   From the nearest right-of-way: 300 feet or the height of the WES, whichever is greater;
      (3)   From the nearest property line: 300 feet or the height of the WES, whichever is greater;
      (4)   From recreation fields: 300 feet or the height of the WES, whichever is greater; and
      (5)   No portion of the WES, including the blades, shall extend over any above ground power line or utility easement.
   (D)   The WES shall be equipped with both automatic and manual braking systems capable of stopping the WES operation in high winds.
   (E)   The WES shall be grounded to protect against lightning strikes in conformance with the National Electrical Code.
   (F)   The WES shall not have a climbing apparatus within 12 feet of the ground.
   (G)   The WES shall have a sign posted at the base of the tower that contains the following information:
      (1)   A warning of high voltage;
      (2)   The manufacturer’s name;
      (3)   An emergency telephone number; and
      (4)   The emergency shutdown procedures.
   (H)   The WES shall not have affixed or attached lights, reflectors, flashers or any other illumination, except for illumination devices required by FAA.
   (I)   The WES shall be designed and constructed so as to not cause radio and television interference.
   (J)   The city hereby reserves the right upon issuing any WES conditional use permit to inspect the premises on which the WES is located. If the WES is not maintained in safe and operational condition, the owner shall take immediate action to correct the situation.
   (K)   All obsolete and unused towers and equipment must be removed within 12 months of cessation of operation at the site, unless an exemption is granted by the Planning and Zoning Commission.
