§ 116.03 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ACCESSORY STRUCTURE. A subordinate structure on the same lot as the principal dwelling or dwellings, and which is not used nor authorized to be used for living or sleeping by human occupants.
   BOARD OF ADJUSTMENT. The City of Waverly City Council.
   BUILDING. Any structure having a roof intended for the shelter, housing or enclosure of any person, animal, goods or materials of any kind or nature.
   BUILDING INSPECTOR. Any duly authorized representative charged with the administration and enforcement of this chapter.
   CITY COUNCIL. The City of Waverly City Council.
   DWELLING. A building or portion thereof, designed or used predominantly for residential occupancy of a continued nature, including single-family dwellings, two-family dwellings and multiple family dwellings, but not including hotels and motels.
   DWELLING UNIT. A single unit providing complete, independent living facilities for one or more persons including permanent provisions for living, sleeping, eating, cooking and sanitation.
   EFFICIENCY LIVING UNIT. A room having cooking facilities and used for combined living, dining and sleeping purposes.
   GARBAGE. The animal or vegetable waste resulting from the handling, preparation, cooking and consumption of food.
   HABITABLE SPACE. Space in a structure for living, sleeping, eating or cooking, bathrooms, toilet rooms, furnace rooms, unfurnished basements (such as, those without required ventilation, electric outlets and exit facilities), pantries, closets, corridors, stairways, storage spaces, workshops, hobby and recreation areas in parts of the structure below ground level or in attics and any similar areas are not considered habitable space.
   HEATED WATER. Water heated to a temperature between 120º and 130º F. measured at the faucet outlet.
   KITCHEN. A space which contains a sink with counter working space, adequate space for installing cooking and refrigeration equipment and adequate space for the storage of cooking utensils.
   MULTIPLE FAMILY DWELLING. A dwelling, or portion thereof, containing four or more dwelling units.
   OCCUPANT. Any person living or sleeping in a building or having possession of a space within a building.
   OPERATOR. Any person who has charge, care or control of a structure or premises which is let or offered for occupancy.
   OWNER. Any person, agent, operator, firm or corporation having a legal or equitable interest in the property; or recorded in the official records of the state, county or municipality as holding title to the property; or otherwise having control of the property, including the guardian of the estate of any person, and the executor or administrator of the estate of the person if ordered to take possession of real property by a court. Any person representing the actual owner shall be bound to comply with the provisions of this chapter to the same extent as the owner.
   PERMISSIBLE OCCUPANCY. The maximum number of persons permitted to reside in a dwelling unit or rooming unit.
   PERSON. An individual, firm, partnership, association or corporation; the term may extend and be applied to bodies corporate and politic and to partnerships and other unincorporated associations.
   PREMISES. A lot or parcel of land, including any structures thereon.
   PUBLIC HALL. A hall, corridor or passageway for providing egress from a dwelling unit to a public way and not within the exclusive control of one family.
   RENT. Consideration paid for the use of premises, including, but not necessarily limited to, money, services and property. As a verb, the term RENT means to get or give the use of premises in return for such consideration or any combination thereof. The term RENT does not include arrangements whereby a relative, as defined in M.S. § 273.124, Subdivision 1(c), occupies a dwelling for no consideration or for consideration that includes no more than maintenance of the dwelling or premises, and which arrangement is detailed and sworn to in affidavits filed by each adult occupant of the dwelling and each person who is the owner of the dwelling.
   RENTAL DWELLING or DWELLING UNIT. A dwelling or dwelling unit let for rent or lease.
   RODENT HARBORAGE. Any place where rodents can live, nest or seek shelter.
   ROOMING UNIT. Any room or group of rooms forming a single habitable unit occupied or intended to be occupied for sleeping or living, but not for cooking purposes.
   RUBBISH. Combustible and noncombustible waste materials, except garbage; the term shall include the residue from the burning of wood, coal, and other combustible; materials, paper, rags, cartons, boxes, wood, excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals, mineral matter, glass, crockery and other similar materials.
   STRUCTURE. That which is built or constructed or a portion thereof.
   TENANT. A person, whether or not the legal owner of record, occupying a building, or portion thereof, as a unit.
   TOILET ROOM. A room containing a water closet or urinal but not a bathtub or shower.
