531.05 CRIMINAL VIOLATION PENALTIES FOR FAILURE TO CURE A NUISANCE CITATION.
Any Owner who fails to abate the existence of a public Nuisance as required by Section 521.13 et seq. is guilty of a minor misdemeanor and shall be prosecuted pursuant to Section 501.99 and within the limits of the law. Each day that a violation continues after due notice has been served shall be required to pay a fifty dollar ($50.00) per day fine until the Owner cures the Nuisance or commences work on a plan of action to the satisfaction of the Safety Director. If the Owner's plan of action is commenced and this cures the Nuisance, then no further daily fines shall accrue or be due. However, if the Safety Director determines that corrective action or work on the plan of action is not in progress, seizes, or stops without explanation or evidence of continuing efforts to cure the Nuisance, then the fifty dollar ($50.00) per day fine shall commence upon a subsequent Citation, as set forth above.
