961.02 CONTRACTOR’S LICENSE; FEE; TRUCKS.
   No person, firm or corporation other than the Mayor or his authorized agent who holds a lawful contract with this City shall collect, remove or transport residential, commercial or industrial garbage or refuse within the City.
   Council shall have exclusive authority to select and enter into a franchise agreement with the selected contractor. There shall be an annual license fee of one hundred twenty dollars ($120.00) payable by the contractor before January 1 of each year to the Clerk of Council.
   The contractor’s refuse and garbage trucks are to be constructed and maintained so as to prevent a littering of the streets and to prevent spillage or dripping therefrom.
   Before renewing the license each year, the Sanitation Committee of Council shall inspect the garbage and refuse trucks to determine if they continue to meet specified sanitary requirements and inspect the landfill operation to see that specifications are being met.
