945.07 BACKFLOW PREVENTION.
   (a)   If in the judgment and sound discretion of the Superintendent of Water of Village of Waverly ("Superintendent"), or his/her authorized representative, an approved backflow prevention device is necessary for the safety of the public water system for a property located within the boundaries of the Village of Waverly, the Superintendent will give notice to the water consumer to install an approved backflow prevention device. The water consumer shall, at his own expense, install an approved backflow devise at consumer's location in accordance with OAC 3745-95-04 and in a manner approved by the Superintendent, or his/her authorized representative. Not later than thirty (30) days after the anniversary of the device installation date, the customer shall have a person certified by the Department of Commerce and approved by the Superintendent make inspections and test the devices to provide approval or additional requirements for approval. Thereafter, any approved backflow prevention device connected to the water supply system shall be inspected in the same manner on an annual basis in accordance to OAC 3745-95-06-C3. Upon satisfactory completion of such tests, the customer shall submit the inspection and test results in writing to the Waverly Water Department, together with a documentation fee of thirty dollars ($30.00).
 
   (b)   No person, firm or corporation shall establish, or permit to be established or maintain or permit to be maintained, any connection whereby a private auxiliary or emergency water supply other than the regular public water supply system of Village of Waverly, may enter the supply or distributing system of Village of Waverly, unless such private, auxiliary or emergency water supply and the method of connection and use of such supply shall have been approved by the Superintendent, or his/her authorized representative, and by the Ohio Environmental Protection Agency. Additionally, the use of booster pumps are prohibited unless are used in accordance with OAC 3745-95-07 and are initially approved by the Superintendent or his/her authorized representative, before installation. Failure to meet any of these requirements will result in a single notice of disconnect and loss of service until required compliance is met.
 
   (c)   It shall be the duty of the Superintendent, or his/her representative, to cause surveys and investigations to be made of industrial and other properties served by the public water supply where actual or potential hazards to the public water supply may exist. Such surveys and investigations shall be made a matter of public record and shall be repeated as often as the Superintendent, or his/her representative, shall deem necessary.
 
   (d)   The Superintendent, or his/her authorized representative, shall have the right to enter any property served by a connection to the public water system of the Village of Waverly at any reasonable time, for the purpose of inspecting the piping system or systems thereof. On demand, the owner, lessees, or occupants of a property served by a connection to the public water system of the Village of Waverly shall furnish to the Superintendent, or his/her authorized representative, any information that Superintendent, or his/her authorized representative may request regarding the connection system used by such property . The refusal of such information, when demanded, shall, within the discretion of the Superintendent, be deemed evidence of the presence of improper connections as provided in this section.
 
   (e)   After reasonable notice to the occupant of a property served by a connection to the public water system of the Village of Waverly that is determined by the Superintendent, or his/her authorized representative, to be in violation of the provisions of this Ordinance, the Superintendent is hereby directed to discontinue, the water service to such property and to take such other precautionary measures as the Superintendent, or his/her authorized representative, may deem necessary to eliminate any danger of contamination of the public water supply. The water service to such property shall not be restored until the property is in compliance with the provisions of this Ordinance.
 
   (f)   The Superintendent shall adopt Rules and Regulations the Superintendent determines necessary for the effective enforcement and administration of the cross-connection or backflow prevention program as outlined in this section.
