921.05 TREES DAMAGING ADJOINING PROPERTY; REMOVAL.
   Any person who is the owner of any premises or lot of land on which any tree, regardless of type or family, now standing, whose roots are found to encroach on adjoining property in such a manner as to damage the adjoining property or affect the enjoyment of the adjoining property owner's land, shall cause the tree to be removed within sixty days after written notice is received to remove the tree.
   Notice to remove the tree shall be given by the Director of Public Service only when a complaint has been filed by an adjoining property owner. The notice shall only be issued if the Director of Public Service determines that the roots of the tree encroach in such a manner as to damage the adjoining property or affect the enjoyment of the adjoining property owner’s land.
   If the owner neglects to remove the trees as aforesaid, within thirty days after receiving written notice to do so the City shall cause the same to be removed and charge the expense against the property owner. If the property owner fails to pay the amount within thirty days after notice, the City shall certify the same to the County Auditor to be placed upon the tax duplicate and collected as other taxes are collected according to law.
