Section 6.05 DEPARTMENT OF PUBLIC SERVICE.
   (A)   There is hereby established a Department of Public Service to be headed by the Mayor until the Council shall create the office of Director of Public Service by ordinance or resolution. Upon the creation of the office of Director of Public Service such Director shall be appointed by the Mayor subject to the approval of the Council by a vote of at least three-fourths of its members. The Director of Public Service shall serve at the pleasure of the Mayor and Council and shall, with or without cause, be removed, suspended or otherwise disciplined by the Mayor subject to the approval of the Council by a vote of at least three-fourths of its members.
 
   (B)   The Department of Public Service shall be responsible for the functions of parks, recreation, streets, sanitary and storm sewers, public water supply, treatment and distribution, waste water treatment and such other functions not otherwise assigned by this Charter as provided by ordinance or resolution. The Department of Public Service may be divided into divisions or other sub-units as determined by ordinance or resolution.
 
   (C)   All employees within the Department of Public Service shall, until the office of Director of Public Service is created and such Director is appointed, be under direction and control of the Mayor. Upon the creation of the office of Director of Public Service and the appointment of such Director, such employees shall be under the direction and control of the Director of Public Service subject to the general supervision of the Mayor. The Mayor or Director of Public Service, as appropriate, and other officers and employees within the Department of Public Service shall have those powers, duties and functions as provided by this Charter, the ordinances and resolutions of the Municipality, administrative rules and directives of the Mayor and Director of Public Service and the laws of Ohio, provided that such laws are consistent with this Charter, the Municipality's ordinances and resolutions and the Mayor's and the Director's administrative rules and directives.
