(a) Any structure erected after the effective date of this chapter which is utilized in part as an eating establishment shall not be entitled to the exemption set forth in Section 523.06(j).
(b) When the renovation of a structure requires a state building permit and when some portion of that structure is utilized as an eating establishment, such renovated structure shall not be entitled to the exemption set forth in Section 523.06(j).
(c) All eating establishments constructed and renovated after the effective date of this chapter shall have ventilation and exhaust systems designed and operated to the maximum extent practicable consistent with good engineering practices to minimize the migration and recirculation of smoking to non-smoking areas.
